Vendors are selling AI voice agents that call your leads, qualify them and hand you the live ones. Here's what agents who tried it say, and the compliance line under all of it. Not legal advice; a producer's map.
What agents report. Answer rates on AI-initiated calls are poor, because the calls look like robocalls to the carriers' scoring and get labeled fast. The leads that do get through are annoyed by the time a human picks up. A few agents report it working on warm callbacks to people who already asked to be called, which is a different use than cold outreach.
The line. The FCC ruled in 2024 that an AI-generated voice counts as an artificial or prerecorded voice under the TCPA. That means calls to a cell phone with an AI voice need prior express written consent specific to that kind of call, and the penalties are per call. Most lead consent language doesn't cover it. Ask your E&O carrier what they think before you ask the vendor.
Where AI on the phone is clean. Inbound. A client calls and an assistant handles the routing or the after-hours message. Your own practice calls. Summarizing your recorded calls after the fact. None of that touches a consumer's phone without their action.
What we're doing. We build AI tools for notes, summaries and practice, and we've stayed out of AI dialing consumers for exactly the reasons above. That's a product decision and a compliance one.
